Meek Mill’s Attorney Says Probation Case Judge Crossed Legal Lines

Meek Mill‘s recent probation violation case that landed the Philadelphia star two to four years in jail this week has taken a new turn. According to Meek’s attorney, Joe Tacopina, that the judge in the case, Genece Brinkley, has some manner of weird obsession with the MMG rapper and allegedly asked him to drop his management contract with Roc Nation to join the camp of the judge’s associate.

Billboard reports:

Billboard: What were your initial thoughts after Judge Brinkley revealed Meek’s sentencing on Monday?

Tacopina: It was an enormously grave mischaracter of justice. A really despicable version of what the justice system is supposed to be. There’s three people in the court room besides the defendant: The prosecutors, the district attorney — who’s in charge of enforcing laws and handing out punishments — [and] the probation officer who’s in charge with enforcing people who are on probation making sure that they apply with the law and when they don’t, recommending punishment.

Then, there’s a judge that’s supposed to be a fair, neutral arbitrator and oversee. Both the probation officer and the district attorney recommended no incarceration for these violations. No incarceration. But this judge excoriated both of them, challenged their credibility and overrode both law enforcement agencies recommendations and went from zero to two to four years, which shows that she clearly had a personal vendetta against this guy [Mill].

But when you look at all the other facts, like a judge crossing the line of professionalism and traditional conduct, [who] will make the request that Meek Mill re-record a famous Philadelphia pop band, Boyz II Men’s song “On Bended Knee,” where he concludes with a tribute to her and mentions her by name in the song. And he, of course, was laughing and thought it was a joke, she said, “I’m serious.” He refused to do that.

So, that, right there, was a totally an inappropriate request. When she requests he leaves his current management Roc Nation — which is one of the most important management companies in the world — and goes back to a local Philadelphia guy who has a spotted past because she had a personal relationship with him as manager, again, she’s doing something that a judge would never be doing, having a personal interest.

If true, could this help lessen the sentence levied upon Meek Mill, especially since prosecution in the case didn’t intend to pursue the matter with this manner of ferocity?

Judge Refuses To Throw Out Defamation Suit Against Cosby

BOSTON (AP) — A defamation lawsuit brought against Bill Cosby by three women who say he sexually abused them decades ago can move forward, a federal judge in Massachusetts ruled Friday, delivering a legal blow to the comedian as he attempts to defend himself against accusations of sexual assault by dozens of women.

The women claim in their lawsuit that Cosby’s representatives damaged their reputations by denying their allegations in sometimes disparaging language. Cosby’s lawyers had asked the judge to dismiss their suit, arguing that the remarks were personal opinions protected by the First Amendment and legal declarations made in his defense.

But in his ruling Friday, U.S. District Court Judge Mark Mastroianni rejected Cosby’s bid to dismiss the case before it ever goes to a jury.

The women — Tamara Green, Therese Serignese and Linda Traitz — have accused Cosby of drugging them and then having unwanted sexual contact with them.

The comments they claim were defamatory range from statements dismissing their accusations as “ridiculous claims” and “absurd fabrication” to longer remarks that sought to discredit the accusers.

“As the old saying goes, ‘consider the source,” ended one statement that touched on Traitz’s criminal and prison record.

In his ruling, Mastroianni rejects Cosby’s argument that the statements were legal declarations made in self-defense.

“The court recognizes that some jurisdictions do apply a version of the conditional self-defense privilege, which allows individuals, in certain circumstances, to publish defamatory responsive statements necessary to defend their reputation. However … such a privilege does not permit a defendant to knowingly publish false statements of fact,” the judge wrote in his 38-page ruling.

Telephone messages left for four attorneys who represent Cosby in the Massachusetts lawsuit were not immediately returned. Cosby has a house in Shelburne Falls, in western Massachusetts.

“As we’d expected and hoped, the judge rejected every one of Mr. Cosby’s attempts to throw the case out of court and allowed the case to proceed,” said Joseph Cammarata, an attorney who represents the three women.

“We will take Mr. Cosby’s deposition at the earliest possible moment. My clients look forward to moving the case forward and to restoring their good names and reputations.”

“Dateline NBC” aired a special Friday night in which 29 Cosby accusers were interviewed together about their allegations. Cosby has never been charged with a crime and he has denied the allegations.

Cosby was deposed Friday in a Los Angeles case against him. Lawyer Gloria Allred, the defendant’s lawyer in that case, said she would speak on the deposition Saturday in Boston. A third lawsuit in also pending in Los Angeles.

Court documents unsealed in July show Cosby admitting in 2005 to carrying on extramarital relationships with several women, including some who accuse him of sexual assault. The testimony added to the unsavory details that have all but wrecked his nice-guy reputation as TV’s Dr. Cliff Huxtable and made a mockery of his preaching about decency and personal responsibility.

Judge Rules ‘Muslims Are Coming!’ Ads Allowed In NYC Subways

NEW YORK — The mere mention of the word “Muslim” or the simple discussion of Islam is not political, a federal judge ruled Wednesday, ordering New York City’s Metropolitan Transportation Authority to allow a series of subway advertisements for the documentary “The Muslims Are Coming!“ 

The documentary follows a group of Muslim comedians on a standup tour of the United States in an effort to combat Islamophobia. The film’s production company, Vaguely Qualified Productions, sued the MTA in July after the agency wouldn’t allow a subway ad campaign promoting the film. 

The ads in question were decidedly lighthearted and disarming. One poster reads, “BEWARE: The MUSLIMS are COMING! … And they shall strike with hugs so fierce, you’ll end up calling your grandmother and telling her you love her.” 

According to the MTA, however, the campaign violated a new rule it had instituted in April, barring any ads that expressed an opinion regarding “disputed economic, political, moral, religious or social issues.”

The agency had implemented the rule to safeguard itself from legal challenges it often faced when rejecting ads with sometimes vile political messages. (Courts, for example, had previously forced the MTA to post Islamophobic ads created by the American Freedom Defense Initiative, a hate group.)

The decision to not allow the “Muslims Are Coming!” subway ads, lawyers for the MTA argued, was a “reasonable and viewpoint neutral” decision.  

But in her written decision Wednesday, U.S. District Judge Colleen McMahon found the MTA’s argument insufficient.

“Indeed, the evidence before the court plainly indicates that VQP’s silly advertisements were subject to greater scrutiny than other potentially controversial ads,” she wrote. “An advertisement for Freelancers Union that was accepted by the MTA and displayed in the subways included the following text, in comic book-style font: “Funny how corporations are people when it comes to politics but faceless machines when it comes to PAYING actual people.”

Judge McMahon pointed to other ads the MTA had accepted. There was a CNN ad for the network’s coverage of a Republican presidential debate, which included photos of the candidates alongside quotes, including John Kasich’s: “It is a bad system when billionaires can pick the one who can be the president.”

And the MTA accepted an ad for the television show “Mr. Robot,” which included text saying, “PRIVACY IS A MYTH,” “CORPORATIONS OWN YOUR MINDS” and “BANKS OWN YOUR MONEY.”

The “Mr. Robot” ad in particular, Judge McMahon wrote, was “more blatantly ‘political’ … than are [Vaugley Qualified Production’s] ads for its movie, which take on religious intolerance with gentle humor.” 

The ads for “The Muslim’s Are Coming!” Judge McMahon added, are “not ‘prominently or predominantly political’ — unless we have reached the unhappy moment in this country where the mere mention of one of the three Abrahamic faiths is ‘prominently or predominantly political’ simply because that faith is Islam.” 

“And that the advertisements at issue gently mock prejudice and employ Islamophobia as a comedic device does not make their message ‘prominently or predominately’ political,” the judge added. 

Two of the film’s featured Muslim comedians, Dean Obeidallah and Negin Farsad, applauded the judge’s decision Wednesday. 

“We’re thrilled that the judge in this case recognized that our Muslim background was not a political issue,” said Obeidallah in a statement. “Like so many other comedians, we can continue performing and make people laugh by using our personal lives and experiences as fodder for our shows.”

“Shutting down a couple of American Muslim comedians from spreading delightfulness on the subway? That never made sense,” said Farsad. “This has been a victory of reason and freedom of speech over ridiculousness. MTA subway posters just got way more hilarious and 100% more Muslim.”

Glenn Katon, the legal director at Muslim Advocates, which filed the lawsuit on behalf of Vaguely Qualified Productions, said that “the court decision upholds our claim that sharing humor and stories by and about American Muslims educates the public about the Muslim community and should not be considered political speech,” 

Adam Lisberg, a spokesperson for the MTA, told The Wall Street Journal that the agency is reviewing the judge’s decision.

Cognitive Dissonance: You be the Judge

Here’s an interesting article in the Washington Post that explains why Trump is still leading in the polls. At least so far. The explanation for Trump’s continued rise in the polls, according to a convincing chart in the article, is that the media is giving him all of the attention.

Now refer back to my post on how to spot a tell for cognitive dissonance, and take a look at the one titled nonsense rebuttal.

Okay, armed with that knowledge, you get to judge whether it is I who is experiencing cognitive dissonance or the author of the article. 

We both have a strong bias on this topic, so realistically, he and I have zero credibility on this question. That’s why I deputize you to be the deciders.

My view is that early in the race (five minutes ahead of time) Trump asked himself what he needed to do in order to suck all of the attention out of the entire universe and starve the lesser-known candidates. Then he did it. Because that is the obvious play. And the media danced.

The article by Mr. Sides takes the view that the media is not the puppet in the middle but rather the prime cause of Trump’s rise. By this view, Trump is just shiny and fun and his novelty will fade.

One of us is blind to the obvious. Right?

I am not qualified to judge my own cognitive dissonance, so I leave it to you.

The long-delayed “Big Pimpin” lawsuit is finally set to be underway and defendant Jay Z is taking no chances when it boils down to coming out-of-pocket (more than he’s supposed to).

TMZ is reporting that the megastar rapper born Shawn Carter is asking a judge to disallow the future jury from glancing into his finances and his criminal history in order to have their opinions being swayed as the case develops.

To backtrack for those not in the know, the sampled foundation behind Jay Z and Timbaland’s 1999 smash hit was a 1960s Egyptian song titled “Khosara Khosara,” and the artist’s heir, Abdel Halim Hafez, is claiming the Hip-Hop pair not only infringed on the copyright of the record, but lyrically used it in a demeaning way. The case has been eight years in the making and will finally go to court in October, where Jay Z is expected to testify.

Carter, easily one of the most successful–commercially and financially–Hip-Hop artists to ever grace a mic, values at net worth of $ 550 million according to a very recent Forbes report. Allowing a prosecutor to paint the picture that he got rich stealing from unknown artists would spell a certain doom for the case. On the contrary, the plaintiff is claiming that since Jay Z “stole” the “Big Pimpin” sample, his criminal past is very much on the table here.

We’re guessing an out-of-court settlement is also out?

The Struggle Files: Judge Denies Brittney Griner’s Annulment From Glory Johnson

Brittney Griner’s struggle just got more real. A judge has denied the WNBA star’s request that her 28-day marriage to a now pregnant Glory Johnson be annulled.

WNBA players Glory Johnson and Brittney Griner remain married for now after an Arizona judge on Wednesday rejected Griner’s request to annul the short-lived union, a member of Johnson’s camp confirms to PEOPLE exclusively.

The court decision effectively enforces Griner’s position as the couple’s breadwinner, since Johnson has taken a year off from the court to carry twins – a pregnancy that Johnson, who plays for the Tulsa Shock, announced on June 4, one day before Griner filed to annul the 28-day marriage.

But it also keeps open the door for Griner’s divorce request – filed along with the request for annulment – to proceed. In its exact language, the court found “no legal basis for annulment,” while stating “the case shall proceed on the Petition for Dissolution of Marriage with Minor Children.”

Needless to say Griner is moving forward with the divorce. As for Johnson, who Griner reportedly caught texting an ex-boyfriend, she’s happy with the decision

She told TMZ Sports, “Together we made life changing decisions which impacted our lives collectively, and we both should be held responsible for those decisions.”

Dame Dash Asks Judge To Toss Loisaidas Lawsuit

Damon Dash isn’t letting the recent Loisaidas movie lawsuit go away without a fight. Dash and Kanye West were swept up in a lawsuit filed earlier this year, and this month the entrepreneur asked the judge in the case to throw out the case over the use of the Loisaidas name for the film.

The term “Loisaidas,” a slang term for the Lower East Side of Manhattan, is also the name of a band fronted by Michael Medina, who trademarked the name. Medina filed suit again tWest and Dash, who serve as executive producers for the movie, last spring. Dash countered Medina’s legal jab on Aug. 4, and he’s saying that Medina cannot claim the name as his own.

Dash asked a judge Aug. 4 to throw out musician Michael Medina’s case against him, which claims Dash used the term “Loisaidas” as his film title even though Medina’s group trademarked the name. Medina’s suit, which was filed in April in New York federal court, alleges Dash’s violent “Loisaidas” movie defiled Medina’s Latin music group of the same name, and has confused fans.

But Dash said his decision to use “Loisaidas” was protected by the First Amendment. Dash also said “Loisaidas” – a Spanish slang term for people from the Lower East Side of Manhattan – can’t be owned by anyone because it’s a common word.

“Plaintiff cannot commandeer and monopolize a term that, as Plaintiff admits, is a common part of local “Spanglish” vernacular and prevent others from using that term,” Dash’s lawyer’s said in his answer to Medina’s suit. “In particular, “Loisaidas” has been used for over 40 years to identify residents who live in the Lower East Side…”

Dash also wants Medina to pay his legal fees connected to the ordeal.

Judge Orders Bill Cosby To Give Sworn Deposition In Lawsuit

 

LOS ANGELES, Aug 5 (Reuters) – Bill Cosby has been ordered to give a sworn deposition in a lawsuit brought by a woman accusing the comedian of plying her with alcohol and sexually abusing her at the Playboy Mansion in Los Angeles when she was 15 years old.

It marks the first time Cosby, 78, has been directed to testify under oath in response to a complaint of sexual misconduct against him since a deposition he gave in a separate Pennsylvania case he settled out of court nine years ago.

The latest order, made public on Wednesday, a day after a Los Angeles Superior Court judge entered it, requires Cosby to submit under oath to questions from the lawyer of his Los Angeles accuser, Judy Huth, on Oct. 9. Now in her 50s, Huth must likewise answer questions from his attorneys on Oct. 15.

Huth gained somewhat of a tactical advantage from the judge’s decision compelling Cosby to go first.

The precise times and places were not revealed, but Huth’s lawyer, Gloria Allred, has said she expects to depose Cosby in Massachusetts, where he resides.

The way for the depositions, a key part of the discovery process in civil litigation, was cleared when the California Supreme Court last month denied Cosby’s petition to review the case, dealing a final blow to his efforts to fend off Huth’s lawsuit.

Her complaint, brought in December 2014, charged that Cosby sexually abused her by putting his hand down her pants and then “taking her hand in his hand and performing a sex act on himself without her consent.”

Huth alleged the encounter occurred days after she and a female friend met Cosby at a park where he was filming a movie. According to her account, Cosby invited the girls the following weekend to his tennis club, where they all had drinks together before he led them on to the Playboy Mansion.

Cosby’s attorney Martin Singer has called Huth’s allegations false and “defamatory.”

Huth is one of more than 40 women who have come forward in the past year to say that they were raped or molested by Cosby after he gave them alcohol or drugs in incidents dating back decades.

In 2006 Cosby reached a confidential settlement for an undisclosed sum with a former Temple University employee, Andrea Constand, who accused him of sexual assault. Parts of the deposition he gave in that case were made public last month.

Huth’s complaint is one of at least four pending civil suits against Cosby stemming from such accusations.

However, Allred has said Huth’s is the only one seeking damages for the alleged misconduct itself, citing repressed psychological injuries that she claims were only discovered in the last three years, and therefore are allowed under the statute of limitations.

The other plaintiffs are suing for defamation instead.

Cosby has never been criminally charged. He and his lawyers acknowledge marital infidelity on his part but have consistently denied allegations of criminal wrongdoing. (Editing by Sandra Maler, Eric Walsh and Ken Wills)

Texas Must Recognize Gay Marriage On Death Certificate, Judge Rules

AUSTIN, Texas, Aug 5 (Reuters) – A U.S. judge on Wednesday ordered Texas officials to recognize on a state death certificate the surviving spouse in a same-sex marriage whose husband died earlier this year.

The case comes as states such as Texas, which had barred same-sex marriage, grapple with changes brought by the landmark U.S. Supreme Court decision in June that made gay marriage legal in the United States.

Texas, where Republican leaders have tried to push back against gay marriage, had balked at recognizing John Stone-Hoskins as the surviving spouse on the death certificate of James Stone-Hoskins, according to court documents.

U.S. District Judge Orlando Garcia in San Antonio ordered defendants including Texas Attorney General Ken Paxton, a Republican, and the state’s acting health commissioner to appear in his court next week as he considers whether they should be held in contempt.

The two were not immediately available for comment.

John and James Stone-Hoskins were lawfully married in New Mexico in August 2014 and James died in January 2015. 

Texas refused to recognize John as the surviving spouse at the time of the death and he is seeking to have Texas change its ways now that gay marriage is legal in all states.

He filed a lawsuit on Wednesday in federal court, which prompted the judge’s order. It said Texas has refused to fill in the space on the death certificate for surviving spouse.

Republican Governor Greg Abbott, Paxton, a county clerk and the acting health commissioner were named as defendants. None of them responded to requests for comment on the case.

“Although John has made numerous attempts to have James’s death certificate corrected to reflect John as James’s surviving spouse, Defendants refuse to make this correction – thus refusing to recognize John and James’s marriage,” the lawsuit said.

Neel Lane, an attorney for Stone-Hoskins, said the reason Texas officials refuse to put John’s name on the death certificate is because at the time his spouse died Texas was aggressively denying same-sex couples the right to marry.

“The only reason that he was denied that is because the state was intent on depriving him of his constitutional right,” he said.

Judge Orders 50 Cent Trial To Continue Despite Bankruptcy

Just about everyone figured 50 Cent filing for bankruptcy was a ploy to get out of paying Rick Ross’ baby mama,Lastonia Leviston, $ 5M for leaking her sex tape. Well, it didn’t work. 

The New York Post reports that federal Judge Ann Nevins didn’t go for Fif’s hard luck story of starting from the bottom and rising to the Hip-Hop that his lawyer laid out in court documents.

Says the New York Post:

“It is easy to forget that Mr. Jackson grew up in poverty in South Jamaica, a rough neighborhood of Queens, New York,” papers submitted in the Connecticut bankruptcy court by the rapper’s lawyer say.

“His single mother was murdered when Mr. Jackson was only 8 years old,” attorney Patrick Neligan Jr. wrote. “As a boy, Mr. Jackson dreamed of being a boxer, but by the time he was a teenager, he was caught up in a life of crime.”

But Jackson turned his life around after being shot nine times in 2000.

“After recovering from his injuries, Mr. Jackson determined to improve his life and focused on his music,” the papers trumpet, explaining he went on to become a multi-platinum artist who “typifies the American dream” and even became a philanthropist, feeding poor children and helping 9/11 victims.

Already on the hook for $ 5M the trial to see if Leviston gets any more money for punitive damages begins on Monday, July 20.

Why YOU, Not a Judge, Should Resolve Child-Related Disputes

Judge Frees Kids She Sent To Juvenile Center For Avoiding Lunch With Father

 PONTIAC, Mich. — A judge who sent three children to a juvenile detention center last month for refusing to eat lunch with their father has decided to release them so they can attend summer camp.

Oakland County Circuit Court Judge Lisa Gorcyca lifted her civil contempt order against the Tsimhoni children, ages 9, 10 and 15, at an emergency hearing Friday, ending their more than two weeks of incarceration at the Children’s Village detention center. The judge allowed the kids to immediately be transported to a popular Jewish overnight camp. 

“We’re really happy she’s allowed them to come out and enjoy camp like some of their friends,” Lisa Stern, attorney for mother Maya Eibschitz-Tsimhoni, told reporters at the courthouse. 

The ruling is the latest twist to a five-year divorce battle between Eibschitz-Tsimhoni and her ex-husband, Omer Tsimhoni. On June 24, Gorcyca found the children in contempt for disobeying her order to have a pleasant lunch with their dad and told them they were “brainwashed,” “defiant” and like members of Charles Manson’s cult, according to a court transcript. Gorcyca, a family court judge, warned she may extend their detention until they turned 18 if they didn’t reconcile with their father.

The judge’s order locking up the children provoked public outrage since it was first reported this week by Fox 2 Detroit. One woman at Friday’s hearing said her kids, classmates of the Tsimhoni children, had written them letters and picketed for their release. 

Gorcyca on Friday defended the punishment. She cited her lifelong dedication to working for children’s interests and criticized Fox for starting a “media frenzy” without learning all the facts of the case.

“This was not a punishment. … The court agrees the placement is not ideal,” Gorcyca said, noting that no one had offered an alternative solution. “The decision was made so they could be placed in a setting where they would not be emotionally manipulated by their mother. … My intention was [for the children] to receive independent, objective and caring counseling.”

A Children’s Village staff member told the court that the Tsimhoni children were stable and had shown improvement in counseling sessions. They spent their time interacting with peers, attending summer school, and engaging in activities like hiking and art projects.

 Attorneys appointed to represent each child said their clients reported good treatment at Children’s Village, but wanted to return home to their mom. The parents’ attorneys and the children’s court-appointed guardian ad litem, William Lanset, agreed that the children should be taken out of the center.

“The plan has to involve taking them out of Children’s Village, but it cannot involve the mother,” Lanset told the judge before she ruled. “She damaged these children.”

Eibschitz-Tsimhoni currently has custody of the children. Gorcyca and Lanset rebuked the mother for purposely alienated her kids from their father, sabotaging their relationship and visits, missing court dates, and ignoring court orders.  

In June, the oldest child told the court he didn’t want to spend time with his dad because he was violent and had hit their mother — an allegation the father denied. Gorcyca said Friday that she had never heard credible evidence of abuse or other wrongdoing by Tsimhoni. 

“This father has moved mountains to be part of his children’s life,” the judge said. Tsimhoni visits Michigan often, but lives and works in Israel. He attended Friday’s hearing by phone. His attorney said she would soon be filing a motion for change of custody. 

After the hearing, Eibschitz-Tsimhoni objected to complaints about her by Lanset and the judge, and said she has always wanted the children to have a good relationship with their father.

“I’ve never done anything she said about me,” Eibschitz-Tsimhoni said.“The only thing I always said to the court is that love comes with love. … You can’t force somebody to love.”

Each parent will be allowed supervised visits with the children at camp, and will split the costs. They and their attorneys are making plans for the kids to work with an expert or a program to rebuild their relationship with their father.

Charleston Church Shooting Judge Is Known To Say The N-Word

Charleston County Magistrate James B. Gosnell Jr. has already proven himself to be a questionable choice to preside over the Charleston church shooting case. At the initial hearing for Dylann Roof, the 20-year-old suspected off killing nine innocent Black people on June 17, Gosnell angered many when he divided his sympathy between the victims and Roof’s family, who have been perceived through many reports for letting him fly off the handle due to a lack of parenting.

If that wasn’t enough to get the outrage boiling, the judge also went out of his way to make mention of a bond for the separate gun charge when the nine murders charges made it meaningless to bring up.

Now, just like Roof’s and the families of the victims, the back story of Gosnell is being probed and it has been discovered that he was once publicly reprimanded for openly saying the n-word in court.

In November 2003, Gosnell said he repeated a phrase to a Black defendant that he had heard a Black sheriff’s deputy say out loud at a bond hearing.

“There are four kinds of people in this world… Black people, white people, red necks, and n——,” as learned by The Daily Beast. The reported reasoning for saying the “ill-considered” statement was to get the young defendant to turn his life around.

The South Carolina Supreme Court’s website has official record of the judicial disciplinary order that was issued in October 2005. The next scheduled court date for the Roof case is on October 23.

Judge Orders Arkansas To Recognize In-State Same-Sex Marriages

A federal judge said over 500 same-sex marriages that took place in Arkansas last year must be recognized by the state, according to the AP.

Pulaski County Circuit Judge Wendell Griffen validated marriage licenses that were issued to same-sex couples after another judge struck down the state’s gay marriage ban, the AP reports.

The state’s gay marriage ban was struck down in May 2014 by Pulaski County Judge Chris Piazza, who tossed out the state’s constitutional and legislative ban on same-sex marriage, but did not rule on a law regulating the conduct of county clerks, the AP reported earlier. Some clerks in the state began issuing marriage licenses to same-sex couples before the state Supreme Court issued a stay on Piazza’s ruling.

Griffen was among those who officiated same-sex weddings in May 2014.

Within the next month, the U.S. Supreme Court is expected to issue a ruling on whether states are required to offer same-sex marriage licenses and recognize same-sex marriages performed in other states.

Federal Judge Strikes Down Gay Marriage Ban In Guam

HAGATNA, Guam (AP) — Guam has become the first U.S. territory to recognize gay marriage after a federal judge struck down the prohibition.

U.S. District Court Chief Judge Frances M. Tydingco-Gatewood issued the decision after a hearing Friday morning local time. It goes into effect at 8 a.m. Monday, when gay couples can begin applying for marriage licenses, the Pacific Daily News reported.

Attorneys representing the government of Guam said in a May 18 court document that “should a court strike current Guam law, they would respect and follow such a decision.”

Loretta M. Pangelinan and Kathleen M. Aguero filed the lawsuit in April after the 28-year-old women were denied a marriage license.

They based their lawsuit on a 9th U.S. Circuit Court of Appeals decision last year in favor of same-sex marriage. The U.S. District Court of Guam falls under the 9th Circuit.

Attorneys for the Guam plaintiffs had argued the territory must fall in line with the 9th Circuit decision and accept marriage license applications unless the U.S. Supreme Court rules otherwise. The Supreme Court is expected to rule this month whether gay marriage is a constitutional right. Currently, gay couples can marry in 36 states, the District of Columbia and now, Guam.

Lawyers for Guam Gov. Eddie Calvo and the Office of Vital Statistics registrar said making a decision when a ruling from the high court is imminent is impractical.

Guam Attorney General Elizabeth Barrett-Anderson appointed an attorney to represent Calvo because they didn’t agree on the lawsuit; she was in favor of issuing licenses.

Calvo has said the island’s same-sex marriage law is “being challenged by federal judges that were nominated by a U.S. president and confirmed by a U.S Senate, none of whom were elected through a process that included the people of Guam.”

Guam residents are U.S. citizens, but they don’t have the right to cast ballots for president. The territory elects a delegate to the U.S. House, but the delegate may not vote on legislation. Guam has no representation in the U.S. Senate.

Dancer’s Michael Jackson Molestation Claim Dismissed By Judge

A man who claimed Michael Jackson sexually molested him over two decades ago has attempted a late creditor’s claim against the late entertainer’s estate. On Tuesday, a judge dismissed the charges filed by 32-year-old dancer, Wade Robson.

The case was overseen in Los Angeles Superior Court by Judge Mitchell Beckloff, who heard arguments on the case last month. As reported by MyNewsLa.com, the Jackson estate’s motion to dismiss the case was successful and was bolstered by the fact Robson already testified under oath in 2005 that Jackson never touched him.

Robson, 32, alleged Jackson molested him between 1990-97, though he testified in the singer’s 2005 child molestation trial — which involved another boy and ended with Jackson’s acquittal — that the entertainer did not abuse him.

Attorney Howard Weitzman, on behalf of the Jackson estate, today hailed Beckloff’s ruling.

“The court’s dismissal of Wade Robson’s claim against the estate of Michael Jackson confirms that his lawsuit was inappropriately filed,” Weitzman said. “Mr. Robson testified under oath in a courtroom that Michael never did anything improper with him. The estate believes his testimony was honest when his sole motivation was ‘to tell the truth, the whole truth and nothing but the truth.”‘

Robson needed a judge’s permission to bring a late probate court claim because his court papers were filed in May 2013, nearly four years after the entertainer’s June 25, 2009, overdose death at age 50.

Robson claims that suppressed memories of the alleged molestation began to surface via a series of therapy sessions in 2012. Despite the ruling, Robson’s lawyers claim their client has rights to pursue a case against the estate.

Savagery: Cop Shooter Smiles At Judge After Being Sentenced To 110 Years In Prison

On Easter Sunday 2012, Nakwon Foxworth found himself in the center of a hostage situation where he eventually fired–and wounded–four police officers in Brooklyn.

Following his guilty verdict, a judge rejected all his self-defense arguments and sentenced him to a mind-blowing 110 years in prison, to which Foxworth met the revelation with a cheesy grin.

Reports NYDailyNews:

“I’ll be back,” Nakwon Foxworth said in Brooklyn Supreme Court after apologizing to members of his own family “for my absence” since he was arrested in April 2012 — but never uttering a word of condolence to the Emergency Service Unit cops he shot.

Foxworth, 36, was convicted at trial last month by a jury that did not buy his self-defense argument that he opened fire on cops in the Sheepshead Bay apartment where he was barricaded only after, he claimed, they shot at him first.

The incident happened April 8, 2012 — on Easter Sunday — after Foxworth began arguing with moving men over items blocking the building hallway. Foxworth, who had an arsenal in the apartment, briefly held his pregnant girlfriend and infant son while hostage negotiators tried to defuse the situation.

But the key piece of evidence, Assistant District Attorney Kenneth Taub pointed out, were text messages Foxworth sent during the standoff indicating he had no intention of returning to prison.

It should be noted that while a jury easily convicted Foxworth of shooting the officers, the polar opposite couldn’t be accomplished for Cleveland cop Michael Brelo’s shooting, especially when his aftermath looked like this.

Judge Revokes Chris Brown’s Probation

A judge has totally revoked Chris Brown’s probation in the Rihanna case.

A pair of shootings at club appearances prompted the action, even though Brown was not directly involved in either incident. Authorities feel the singer should serve time, because the shootings happened at his shows.

Sunday in San Jose, five people were shot at a Chris Brown event. And then, Suge Knight was infamously shot at a Breezy party, along with several others at a VMA party in August.

Additionally, a judge said that the singer left the county for San Jose without the permission of the court, which constitutes a violation of his probation.

The singers probation officer said, “There is also concern that when he performs or attends at some of his public events, people will get shot or seriously injured.”

Furthermore, Chris has been arrested a couple of times while on probation, an offense that would normally warrant jail time.

The probation officer recommends jail time, because the singers demonstrates a “pattern of making choices that are counterproductive.”

A formal hearing will happen on March 20.

Who Are We to Judge (Uganda)?

This week The Washington Post highlighted plans by conservative lawmakers in several states to push to expand rights to discriminate against same-sex couples by empowering individuals and businesses to refuse service to gays.

This is happening. In 2014 (nearly 2015). In America.

A state legislator in North Carolina is proposing a bill that allows “government workers to recuse themselves from issuing marriage licenses to same-sex couples,” despite the fact that such unions are now legal in the state.

A group of state congressmen in Texas is preparing a bill “to protect Texas business owners from unconstitutional infringements on their religious liberty” — widely expected to entail measures that threaten the civil rights of gay Texans. Others in the Texas legislature are working to amend the constitution to effectively make LGBT-inclusive nondiscrimination ordinances unenforceable by the cities that have adopted them.

In Michigan the State House has just passed a set of its own highly controversial “religious liberty” bills, including one allowing adoption agencies to refuse placements to couples if it is “in violation of their faith.” Not difficult to read between the lines on that one.

While same-sex couples now have their right to marry enshrined in law in 35 states, this renewed wave of discriminatory and bigoted moves serves as a poignant reminder of how far we have yet to go.

Before we can consider our society and our political leadership to be “progressive” — and certainly before we are in any position to point the finger at other governments of the world that are also moving too slowly toward progress — we must take a realistic look at where we are on this issue. We need to read the fine print.

Despite the strides the LGBT community has made in recent years, bigotry and ignorance toward gays is alive and well in America, as evidenced by what’s occurring on the floors of our capitol buildings.

And this is why I’ve grown frustrated with the battle cries against Uganda’s government. My frustration goes far beyond the points I made in a recent HuffPost blog post on the hypocrisy of decrying Uganda’s policies while turning a blind eye to other offenders around the world. What tests my patience, what troubles me beyond all else, is our propensity for pointing the finger at others while ignoring our own flaws.

The truth is that the United States is not yet at a point where it can self-righteously condemn others for their intolerance toward LGBT people, at least not with a straight face.

Someday we will get there, and we will lead by example. But not today.
